@nakdaddy1: Oh I wasn't arguing against that at all, just merely stating the inherent flaws. His .158 was very high up there, regardless of age.
He's still a moron and was more than likely more than a few beers into his night.
But yeah, here in Indiana, when I had my CDL (commercial driver's license) at my last job, my legal limit was lowered to a .04...even in my own personal vehicle when I wasn't at work.
@opanitch: If you even blow a .08, they have to take you into custody, take you to a local station and/or precinct and administer another test, but without a blood sample, they cannot be 100% sure you were intoxicated. Which is where the "under the influence" part of the charge comes into effect.
Or at least it seems that way. There are OWIs, DWIs and DUIs, and semantics seem to be the only difference in definition.

@psychiccheese: Not totally true. There are state drunk in public laws. But to your point, I do not beleive there is a difference between those under 21 and those of age regarding drunk in public laws. Also, they are not based on BAC, but how coherent the person is. #breathalyzercostume
